Ethics and history of the profession
The activity of the real estate broker dates back to that of the “broker” – one of the oldest professional figures in human history – who initially brokered above all movable goods (animals and agricultural products) to then specialize in the brokerage of real estate (land and buildings). The matchmaker was already known from the times of the Persians and the Arabs. Initially, its function was to put local people in contact to satisfy needs other than those of a commercial nature. Subsequently, during the period of great expansion of the Roman Empire, his figure assumed the function of “mediator in commercial affairs”. Over the following centuries the figure of the broker began to evolve until the birth of a series of rules that led to the current “business agent in mediation”.
The Code of Commerce of the Kingdom of Italy was born on 1 January 1866, in whose legislation the brokers became “mediators” and were divided into two categories: the public ones, who were provided with a mandate, and the “mediators in other types of mediation” , i.e. freight brokers, insurance brokers, ship charter brokers and land and water transport brokers.
The law of 20 March 1913, n.272 established that the profession of mediator was free and without the need for registration in the Rolls of the Chamber of Commerce, with the exception of stockbrokers and those who held public offices.
In 1958, however, the obligation to register in the Register of the Chamber of Commerce was reintroduced: those registered for the first time were given the qualification of “business agents in mediation”. The real estate agent, in particular, is a professional figure (broker) specialized in concluding deals concerning the exchange of real estate or companies.
The professional preparation of the real estate agent must include, also in accordance with the regulations for admission to the role, insights into many of the subjects that have to do with the exchange of real estate or business assets.
Among these we note the appraisal, the rules of private and public law contained in the civil code and in the other applicable rules, the fiscal and tax laws in general (national and local) and banking techniques, rules and principles of urban planning and design , as well as product notions relating to construction techniques and building materials.
The real estate agent is the only professional authorized to assist the sale of real estate since the exercise of the profession is incompatible with any other professional or business activity.
Anyone who carries out the profession without having the right and/or right to do so incurs the crime of (abusive exercise of the profession) as well as not being entitled to any commission compensation.
This evolution of the figure of the broker was necessary to respond to the needs of a rapidly growing and extremely diversified market. Such an attractive market, however, has generated very high competition which has underlined the need to innovate in order to remain competitive.
Precisely for this reason, the first real estate agencies were born, set up as companies with high professional content.
